What should be in a Statement of Particulars.................
Employers are obliged to give this information within two months of taking on an employee. Employers are also obliged to disclose this information (and more) at least two weeks before a 'TUPE' transfer. It does not necessarily give an employer any of the rights they can contract for but is the basic legal minimum employers are required to issue. Information & Consultation of Employees Regulations 2004 .................
For over 25 years, the law has imposed a duty on employers to consult with employees when redundancies are proposed and when all or part of a business is being transferred. The details have varied, but rules on this have been in place a long time. As a result of EU directives, there are now UK regulations which impose a general obligation on employers above a certain size to make provision for employee information and consultation. TUPE transfers and pension protection .................
